Terms and Conditions

Welcome to Tusk Canopies! By accessing or using our website and services, you agree to comply with and be bound by the following terms and conditions. Please read these carefully. If you do not agree to these terms, please refrain from using our website or services.

1. Introduction

These Terms and Conditions govern the use of our website and the purchase of products from Tusk Canopies. By accessing our website or placing an order, you agree to be bound by these terms. If you have any questions, please contact us at sales@tuskcanopies.co.za.

2. Orders and Payments

  • Placing an Order: Orders can be placed via our website, email, or by phone. Once you place an order, you will receive a confirmation email outlining the details.
  • Payment: Payment is due at the time of order placement.  All transactions are processed securely, and no payment information is stored by Tusk Canopies.
  • Pricing: All prices listed on our website are in South African Rand (ZAR) and inclusive of VAT unless otherwise stated. Tusk Canopies reserves the right to adjust prices without notice.
  • Cancellations: Once an order is placed, cancellations can be requested within 24 hours after confirmation. However, custom or made-to-order products cannot be cancelled once production has begun.

3. Delivery

  • Shipping: We offer nationwide delivery in South Africa. Delivery times may vary depending on your location and the type of product ordered. Estimated delivery times will be communicated when your order is confirmed.
  • Shipping Costs: Shipping costs are calculated based on the destination and the size of the order. Shipping costs will be provided at the time of checkout or order confirmation.
  • Risk of Loss: Risk of loss for products passes to you upon delivery of the items to the shipping carrier. Tusk Canopies is not liable for any delays or damages caused during shipping, but we will assist in resolving any shipping issues.

4. Returns and Refunds

  • Returns: We accept returns on unused and undamaged items within 14 days of delivery. Custom or made-to-order products are not eligible for return.
  • Refunds: Refunds will be processed upon the receipt and inspection of the returned items. Refunds are made to the original payment method used for the purchase. Shipping fees are non-refundable.
  • Defective Products: If you receive a defective or damaged product, please contact us immediately, and we will arrange for a replacement or refund.

5. Custom Products

For all custom-built canopies or fabricated products:

  • Design Approval: Custom designs will require customer approval before production begins. Any modifications must be made prior to approval.
  • Production Time: The production time for custom products is 3-5 working weeks, but this may vary based on design complexity.
  • Non-Refundable: Custom or made-to-order products are non-refundable and non-returnable unless they are defective.

6. Intellectual Property

  • Content Ownership: All content on this website, including text, logos, designs, and product descriptions, are the property of Tusk Canopies and are protected by intellectual property laws.
  • Use of Content: You may not reproduce, distribute, or use any content from our website for commercial purposes without obtaining explicit permission from Tusk Canopies.

7. Warranties and Disclaimers

  • Product Warranties: Tusk Canopies products come with a 12-month warranty against manufacturing defects. This warranty does not cover damages caused by misuse, neglect, or improper installation.
  • Website Use: While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or reliability of any content or products on our website. Tusk Canopies is not responsible for any errors or omissions.

8. Limitation of Liability

Tusk Canopies will not be liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use our website or products. Our liability is limited to the value of the products purchased by the customer.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of South Africa. Any disputes arising from the use of our website or purchase of products will be subject to the exclusive jurisdiction of the courts of South Africa.

We reserve the right to modify or update these Terms and Conditions at any time. Changes will be effective immediately upon posting on this page. We encourage you to review these terms regularly.
